I want to change my employer from A to B. B has filled for h1b transfer on 26-sept-2007 (I have fedex tracking number). Till today (9-oct-2007) we hv not received the receipt notice.

My expected start date was 1-oct which has been extended twice, i.e 8th & then 15th. If receipt does not come will 15th, then can I join the new employer?

Is there any way I can find out the file position/status using fedex tracking number?

Can new employer file one more application for h1 transfer under premium process?

I was on H1 visa and laid off from job on 10/30/09. I got severance pay for Nov. and have the pay stubs. I applied for COS from H4 to F1 for my spouse (already in collage) and H1 to F2 for me on 12/9/09. Meanwhile immigration performed spot check at my ex-employers on 12/3/09, so they came to know that i was not working. My employer had not revoked H1 by then. Our COS application was received by USCIS on 12/14/2009, case is currently under Initial Review.
- Will the immigration officers who did spot check inform USCIS that i was out of status?
- Will case get rejected due to delay in applying for COS?
- Will there be any complications in transferring my H1 to new employer as i was out of status for about a month before i applied for COS?
- How to stop F2 COS if i get H1 transfer approved first?

Hi,

I am not sure if I am posting this question to the wrong thread, so sorry if that's so....

I was told by the lawyer that I needed I-140 approved in order to ask for 3 years instead of 1 year for my H1B extension. They filed the extension asking for 1 year, and a week later we have the I-140 approved. My current H1B expiration date is in June 2009.

Now,
1) is there a way to ask H1B extension for 3 years at this point?
2) If so, does that mean a new application, or an amendment/correction to the old one?
3) Is it worth the hassle to ask for 3 Year extension if it's possible?

Hi,

I have an approved labor, H1 Visa stamp still valid 2.5 years more. I will be applying for I140/485 once this debacle settles.

Can any one tell me, what are the consequences of leaving the US for a weeks vacation in India, while the application is in progress? Some say it is abandoning the application.....Would anyone know

Also, my wife is now on a B1. When I add her name to the 140/485 and she comes back as an H4, will it cause issues

In the right hand column on the homepage the threads used to be listed in chronological order with the one containing the last post on top.

Now it has changed so that I get the threads listed randomly.

Tech gurus - is there a way to fix this so that I can see the latest post on top like I used to previously.

I have a question regarding location change with same employer. I have labor approved on EB2 India with PD 01/2005. I am employed with a big health care firm which has various locations in the region. I'd like to move to another location which is 30 miles away from my present site. I140 is pending with the same employer. I have also posed this question to my lawyer but appreciate greatly if anyone knows answer to this. Will this affect my GC?

My lawyer selected option "a" in section 2 of I-485 for I-140/I-485 filed concurrently. Some members are saying that their lawyer selected option "h". Can some one tell me what must be the correct option for concurrent filing? If option h is correct, Is it possible to amend the existing petition?

started as an intern with local in the month of march 06 and I was given offer till end of august. but my school official gave me work permit on a semester basis and gave it only for srping 06, which end in may 15th. I couldn't update my CPT status for 1 day for summer 06 and started on 16th may, so the school official has said that i am out of status.Since re-instatement is not possible from school as it was unauthorized work permit. They have advised me to go to home country and attend visa to be eligible for reinstatement. I have grauduated last month with masters of science..

They said they will provide me recommendation letter for me to show to consular officer. Also, I have an MBA admit in same university for spring 2007.

so should i come to new program..if thats the case how to get an emergency appoitment.

Hello All,
I am stuck in a very painful scenario right now. I am working on F1-OPT which ends on Feb 5th 2011 and have a pending H1-B application under premium processing. The thing is my employer says that they will terminate me on Feb 4th and cannot guarantee a rehiring even if H1-B is approved.
My employer needs to know if there is something (legal) like temporary termination and rehiring ? If yes then what does the employer need to do to rehire. And is there any documentation about this. My employer wants to check this documentation before reconsidering.
Any inputs would be appreciated.
