A friend of mine was recently stuck in administrative processing from November till March 13th (he was informed about the approval on March 18th) a total timeframe of 5 months. He reached the US on March 22nd and was admitted on H1 without any issues.

He sent me the following facebook link which list at least 200 such cases of similar souls.

Hi,

I got an LUD on my I140 on 07/28/07. There is no message change though. This I-140 was approved way back in Aug 2006. I have filed my I-485 etc on June 1st 07, and its in process. Does anyone know what doesn this LUD mean.

The reason I am asking is I-485 is itself a COS and if we apply H1 while on L1 it is again an COS petition from L1 to H1. So what happens to the I-485 application?:confused:

Current status L1A, exp 9/5/08 (family on L2)
Pending: I-140 EB1C, RD 3/5/07, still no news from Nebraska

Fact: My family members MUST travel to Europe this summer.
Fact: My extension I-129 for a renewed L1A must be submitted to USCIS no later than 6 weeks before 9/5/08.
Fact: I have L1A visa stamp and family have L2 visa stamps with expiration date 9/5/08 in our passports

Question:
How late is the latest my family members can enter US without encountering trouble at the border?
They need to be present in the US to submit the I-539 (extension of stay), but can it be submitted AFTER my I-129 or MUST they be submitted at the same time as an absolute rule?

Please advise.

I applied for extension of stay to California Sercice Center. But if I move to Texas, will be my case transfered to VSC??

if it is an extension of B2 status, I don't think your case will be transferred to a different center if you move to a different state. you just have to inform the service center regarding change of address(I think you can send a AR-11 form) this is just my personal opinion. please check with the lawyer who filed your extension or other experts

My details:

India/EB3/PD:Sep2003/I140 Approved.
I485/EAD/AP: Recevied July 28

I completed FP appointment last week (Wednesday), but LUD has not changed since then.

Also EAD status changed twice (before undergoing FP) it said Card Production Ordered. Today it changed to Approval Notice sent.

Questions:

1. Is there any relation between FP and EAD ? (e.g. Prints appear on EAD etc)
2. Is that the right sequence in change of status:
"Card Production Ordered" followed by "Approval Notice Sent".

Hi,

My H1B Visa expires in Aug 2009 (it was after first extension, till date i have already consumed 3 years 6 months in US). I have following questions,

1. After filing the extension next month, Can I leave to India immediately after getting the receiept (before approval). I might plan to come back to US after a year or so! I will be working at offshore for the same company.

2. If i leave a gap of 365 days, would i regain full 6 years after my re-entry in USA with the existing Visa itself?

I am very sorry if this is a repeated question, i did spend ample time investigating this query and then decided to post this in a thread.

Hi, I have approved H1b through company "NewCompany" but my GC sponsoring company "GCcompany" is planning to cancel my APPROVED 140. Again, I know USCIS will do inted to deny and Yes, I have filed for 485 + it's been 180+ days but I guess the most important question of all is:-

"Will this affect my H1B status?' Since the approval for new 3 year (extension) was based on my 140 and now this thing is under jeopardy. If I use EAD, my wife will no longer be H4 and thats a different problem- Gosh when is thind going to end?"

I had filed for Advance Parole renewal for me and my wife in July since our APs were expiring in mid October. I got the renewed Advance Parole last week with the expiry date as Oct 2011. My wife got hers today but instead of October, it has the start date of Aug 2010 and expires on Aug 2011. I don't know why the USCIS handled it in this way. She has lost 2 months. The Advance Parole extension was paper filed at the Texas Service Center. Can anyone tell me how I can get this rectified, if at all it is possible.

Will it be ok to change employers multiple times on EAD with in shrt span of time difference?

yes, after being a 'chicken' for so long, I changed job on AC21 six months back. And since then changed twice after that. (once forced due to economy, second time moved to a better position) in fact now I am loving the freedom that comes with EAD. Only make sure you stick to same profession (programming) other things like salary or job title etc doesn't matter. Good Luck!

Hello All,
I am on H1 Right now and through the same employer i filed my GC in May 2007 (I-140 approved in Oct' 2007)
but I have got an offer from another company who is willing to transfer my H1, so wanted to know what is the best options.

- Should i Switch on H1 and if yes, can i start working for them before the H1 Transfer process is complete
- If I did decide to go on H1 then do i need to file some documents for my I-485 and EAD Renewal as well (meaning do i have to inform USCIS about my change in employer for GC application)

Therefore the official death of the CIR bill was crucial for the fate of the SKIL bill, as it couldn't be picked up by the Senate as long as the CIR was pending with the House.

Could anyone share their experience/knowledge about getting home loan on EAD? My bank says that, for non-FHA loans, you need to be in any of the visa categories like H1, TN1, GC, ... But its list doesn't include EAD or Adjustment of Status. Can that list be challenged to include EAD? That is, how to convince the bank/lending inst that EAD is a legal/legitimate status like H1?

Hello. I am playing around with making a little app that allows me to draw a polygon shape and then determine how many rectangles can fit inside that shape. The rectangles only have two widths, but can be as long as needed.

It occurred to me that I might somehow be able to have that polygon shape act like a wrap panel and the rectangles inside would self-adjust based on the space provided. Two questions:

1) Is it possible to make a wrap panel with custom borders (not just rectangular)?
2) Is there an equivalent component, to the wrap panel, in Flash? If so, can that component have custom borders?

WASHINGTON, May 25 � After five months in power, Congressional Democrats headed home for their Memorial Day recess with only a few signature accomplishments on the domestic front, notably an increase in the minimum wage, and the prospect of returning to a renewed struggle with the Bush administration over the war in Iraq.

But Democratic leaders say their principal accomplishment, so far, is not reflected in the legislative scorecard: The transformation of the policy debate and the reassertion of Congressional power, especially on the Iraq war.

�We�ve moved the national debate on the war,� said Senator Richard J. Durbin of Illinois, the No. 2 Democrat in the Senate. �We were sleepwalking through this war until the Congress changed hands. And now, every month, this president faces another challenge to his policy.�

The spending legislation for Iraq that passed Thursday night, which lacked a timeline for troop withdrawal, left much of the party�s antiwar base unhappy, and carried only a third of the Democratic votes in the House. But Democratic leaders promised to ratchet up the pressure on President Bush for an exit strategy in Iraq, and they have the legislative vehicles to do so in June and July, building to what all sides expect to be a clash this fall. Top military leaders have committed to delivering a progress report on their troop buildup strategy in September.

Speaker Nancy Pelosi of California tried to send a clear message on Friday that any legislative victory Mr. Bush won this week, when Democrats acceded to his demands and removed the withdrawal timeline, would be short-lived. �We are going to bring an end to this war,� Ms. Pelosi said. �All of us have that goal.�

On the domestic front, Democrats passed the first minimum wage increase in 10 years this week; it was the first item in their campaign agenda from last year, called �Six-for-06,� to win final passage. Other items are prepared for final votes this summer, including an expansion of embryonic stem cell research and the recommendations of the Sept 11 commission on domestic security.

The Democrats made their mark in other ways � notably, using their committee and oversight powers for a broad challenge to administration policies, on issues including the treatment of wounded Iraq veterans and the dismissals of United States attorneys by the Justice Department. Senate Democrats said they had held 75 hearings related to Iraq in the last five months.

Even so, in the inevitable message wars, Republican leaders portrayed the Democrats as disorganized and ineffective, sending Republican members home this weekend with talking points that declare, �Democrats accomplish none in �07.� Representative John A. Boehner of Ohio, the Republican leader, said Friday that the Democrats� first five months were �marked by broken promises, missed opportunities and gridlock caused by strife within the majority party�s ranks.�

But senior Republican officials and some lawmakers privately admitted that Democrats won some victories in recent days, including progress on an immigration overhaul in the Senate and the strong House vote on new lobbying rules.

One of the biggest complaints of Republicans is that House Democrats, who promised to be fairer and more bipartisan in the conduct of floor debate after a decade of heavy-handed Republican rule, have not delivered. Top Democrats admit privately that there is merit to those complaints, and have begun negotiations to try to cool the partisan tensions.

Democrats themselves reflected that little came easily over the last five months, which offered a lesson in the difficulties of governing with very slim majorities, especially in the Senate. Moreover, there are real fault lines and divisions within the party, most apparent, perhaps, on how fast and how far to go in demanding an end to the war in Iraq.

�It�s been a tough slog,� said a senior House Democratic strategist close to the leadership, alluding to the difficulties in managing the spending bill for Iraq. �You�re asking people to vote for a moderate plan instead of the plan that�s closest to their hearts.�

Representative Jim McGovern, Democrat of Massachusetts and a leader in the antiwar caucus, said Thursday night: �A lot of us are frustrated that the war�s still going on. But the fact of the matter is, there�s movement, there�s significant movement, from where we were last November to where we are now.�

Many of the party�s liberal activists, though, remained angry at what they saw as a capitulation to Mr. Bush.

Other fault lines were re-emerging in the party. House Democrats are only beginning to deal with their deep divisions on trade, as a closed caucus this week underscored. Some freshmen, like Representative Betty Sutton, Democrat of Ohio, are intent on making major changes to American trade policy, much greater than the recent deal with the Bush administration on environmental and labor standards announced by the Democratic leadership.

�Our problems with the trading system and the fact that it is broken are much bigger than just having these standards on paper,� Ms. Sutton said.

Down the road, more internal clashes are likely over taxes and spending priorities. Julian Zelizer, a historian and expert on Congress at Boston University, said Ms. Pelosi�s job would, in many ways, get harder once she moved beyond the war. �In some ways, the divisions over domestic issues are just as great, on things like trade,� Mr. Zelizer said.

Both Ms. Pelosi and her Senate counterpart, Senator Harry Reid of Nevada, have had their struggles this year. Mr. Reid drew fire for, among other things, suggesting that the Iraq war was lost. But Democratic senators have expressed strong confidence in his leadership. Ms. Pelosi, the first female speaker, has been a target of repeated Republican efforts to embarrass her. But she has weathered them and has generally held fractious Democrats together.

Representative Barney Frank, Democrat of Massachusetts, said Thursday night: �To some extent, the Democratic leadership fought above its weight. They don�t really have the votes in the Senate.�

Mr. Frank argued that sending Mr. Bush the initial Iraq spending bill, with a withdrawal timeline, and forcing him to veto it would one day be viewed as a turning point after a long pattern of �Congressional ducking.�

�I think Congress has come closer to standing up this time,� he said.

This survey intends to understand the needs of our membership for this provision and collect grassroots information.

So far we have around 1100 people who have responded. Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

I have a approved I-360 (Batter Spouse Petition) and a pending I-485. However I got a letter in the mail stating the will revoke my 1-360 based on Section 204(a)(1) of the Immigration and nationality Act! It further states that I am not a person of Good Moral Character.

I was arrested in Belize my home country on November 19 2002 for Harm.Which would be Assault, and charged $100.00 and released.
This was not include in my initial application becausse it was outside the 3year period since my application was in 2007.

So I got the court documents and I am ready to submit it! but I am not sure if I shoudl seek legal advise or just submit the required document that they want!

They are asking for:
1.) Arrest Report.
2.)Copies of Cout documnet showing final disposition.
3.) relevan excerpts of the law for that jurisdiction showing Maximum possible penalty for each charge.

Please advise! is this something I should be feareful of?

I am renewing advance parole (i-131 form) for me and my wife. Can some one answer what the "class of admission" means on the form and how do we fill it?

I entered the US as H1-B but moved to EAD status last month.
My wife entered the US on advance parole and is currently working on EAD.

hI ATTY I am working under an h1b visa right now as of 2011. But i had a previous petitioned by another employer way back 2006. There was an I-140 filed but it was denied and I never heard from my petitioner then. I do have the USCIS copy and case number. Can I look for another employer and atty that could reopen the case?? IS the HDFC bank receipt number a 10 digit one? It has space for only 10 digits on the website while booking an appointment. My number has an 'A' before the 10 digits. When i enter just the 10 digits it says "Cast from string "undefined/undefined/undefined" to type 'Date' is not valid". 2 business days havent been completed yet (since the payment) and that might be one of the reasons but i am not sure yet. Anybody see this before?

Also, as i understand once this goes through, i will be able to fill in the details for the DS-156 and DS-157 automatically and dont need to go to any other site. Appreciate your insight

Hi,


My current status is

I currently work for Company A (on H1B) and Company B is processing my GC (EB2, I140 approved; I485 in process) .

This month, I found a new job with Company C which I have to join on EAD (they don't do H1Bs). Also, in this month's bulletin, my PD became current. I had a few concerns/questions

1) Could the change in employment trigger any flags since I am changing companies and this is a future employment GC case (though its almost 3 years since the I-485 was filed)

2) What do you suggest I do since its so close? I waited all this time just not to complicate things (and remain on H1) but then as soon as have to start work on EAD, the date also becomes current (which I am definitely very happy about ) but now since both these events are so close, I am not sure what to do.

3) What other things are there to keep in mind in case of a future employment case?

Following is my case details -

Visa and I94 expiration date: 12 Sep 2009
Filed H1 extension: 11 Sep 2009
Extension denied: 18 Nov 2009
Left US: 15 Dec 2009

Refiled H1 Visa: 15 Dec 2009
Visa apporoved: 22 Dec 2009

What should my answer for following question in DS-156 as I left US within 30 days of receiving the denial letter?

Have you ever violated the terms of a U.S. visa, or been unlawfully present in, or deported from, the United States?

Can one obtain a photo ID on a visitor visa? This way the visitor need not go everywhere with his / her passport. Please advise.
If you can manage to get the points required to get a State Photo ID then you can get it. It will be valid for the period of the visitor visa.

I realize they dont acknowledge anywhere the lack of visa numbers as a problem with EB immigration. They only speak of processing times delays and hiring more staff to overcome that.

Hi,

I have changed to a new employer using AC-21 recently. I have pro-actively sent AC-21 documentation (new offer of employment, covering letter and supporting docs) to USCIS. Ever since, I am checking my case online. Its about 3 months now that I have sent this info and there has not been any update/LUD on my 485 case so far. I am not sure if my I-485 case has details about my new employment.

I am currently doing my EAD renewal. I am thinking if it will be possible to indicate to USCIS about my new employment. Can you please advice on -
a) if it is wise to do so?
b) How can it be done?

As many readers may know for I-129 that is used for H, L and O Petition has been revised. On December 20, 2010, USCIS informed stakeholders that it will accept previous editions of Form I-129 that are postmarked on or before December 22, 2010. Petitions postmarked on or after December 23, 2010, must include the new Form-129 with a November 23, 2010, revision date or else they will be rejected. This contradicts earlier guidance stating that the last day USCIS could accept previous editions of the form was December 22, 2010.

We hope that this update clarifies some of the confusion regarding the last date the old form can still be used.

as biased as you'd expect, but useful. I am not bothered, I think most people are not as good as the gear they are using anyway. And besides, I don't stress about other cars on the street. Different strokes for different folks...!!!
