I may be ignorant here but why do you have 2 I-94s? Your I94 is invalid once you leave the country. So I would think the number on the latest and current I94 is the number you would use.

Yes, as long as the new job is same/similar to job B. The 180 days count is number of calendar days i-485 is pending, not number of days on the job. One may not even be working at all during that 180 days, or even while waiting for i-485 approval however, must have a very good excuse because IOs will be very suspicious. It is not violating any rules though as i-485 is for future employment.

I applied for I-485, I-140,and EAD almost 2 months ago..The package was received by USCIS but no receipts yet, no checks are cashed yet...We called and they said it may take 3 months to issue receipts...what should I expect?Receipts and approval of EAD in a month given that they usually honor the 3 months period to approve EAD?or nothing is guaranteed!!

I was laid off in Dec 2009, but severance will stop till early Feb. Now I found two potential jobs. Company A is a corporation in same state, but company B is a university in some other State.
1. How long will take them to transfer my H1B? does the different States matter on this transfer time? I want to make sure which one can submit the H1B transfer before my paycheck stops in Feb.
2. In order to apply for Green Card later, which job is better for Green Card application? I heard university will not help the staff (accountant) for Green Card application. Is that true?

The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. This year 5,900 regular applications were received in the first week and 4,500 advanced degree petitions. USCIS just reported that in the second week of counting, 7,100 regular cases were receipted and 5,100 advanced degree applications. The Senator Chuck Schumer (D-NY), the Immigration Subcommittee Chairman, told the AP yesterday that he plans on introducing a comprehensive immigration reform bill before Labor Day and then hopes to have a debate on the bill in the fall. Schumer hinted that advocates for highly skilled immigrants are likely to be happier with the bill than those pushing for guest worker reforms for lesser skilled workers and that business and the unions have yet to reach a compromise. Hi,
I am currently on 8th year of H1-B, employer to file for 9th year H1 extension next week. Labor filed in Dec 07, denied in Jan 10, appealed immediately. Currently awaiting response to the labor appeal. H1 expires in Jan 2011.
I work for a consulting firm and my client has been requesting me to join full time as an employee, willing to transfer H1 immediately. My question to the experts is
If I change employer, will I have to start everything from scratch or can i continue the GC from where my current employer left?
And given the current political situation (due to the economy), should I stick to current employer until H1 extension goes through and then make a move (if any possibilities exist)?
Any advise is much appreciated.

I just filed for an H1B transfer in April. My current H1 is valid till April 2010. Just got an email from CRIS stating that my current I-129 case which was approved in April 2007 has been reopened at USCIS determination for review. Is there a problem or is it just normal procedure to look at the original H1B petition? Have transfered H1B before but have never had this happen. Is this something new that they are doing? Incidentally I am on the 10th year of my H1B and have a copy of the approved I-140 based on which we filed for a 3 year extension.

Hi, I have my labor approved by Company A and I140 filed as soon as I got the labor. Before this I140 got approved I changed to Company B who filed for my labor and applied for I140 as soon as it got approved. My I140 with company B got approved and then the I140 with the old company A got approved 3 months later. Can I somehow get the old PD. Can some one who have been in similar situation or know some one in the similar situation answer this. I will be able to get a 2 year advance if this works out.

It depends, on several factors inlcuding which service center it filed, is there any RFE or any document missing etc.
In ideal case it geenrally takes 4-8+ weeks.
If you want any fater within 2 weeks) you can file under premium prossing with addtional 1000$ fee.

I have this thought. We start a letter campaign sending letters to all the house members: 1) To get them aware of Legal immigration and 2) To put our case fwd.
I feel it will be very effective as the flower campaign. Atleast most of us can participate in it, less expensive, less time consuming. And we can see why we wouldn't they respond to the bulk of mail they are getting every day.
I know we did letters through email etc. But i think sending through post will be different and they will be obligated to respond.
I do not know whether this is a good idea. so please dont rush at me.:)

Hello,
this is a bit different maybe since it deals with my mom. She was sponsored by my sister. She has been stuck in name check now for about 18 monts. Anyways, she is out of the country. She just left, and now my sister got a letter and appoinment letter for a 2nd finger print. My mother is using her advacne parole and the green card was filed for adjustment of status.
so the questiong is can my sister reschedule the appointment 8 months in the future or can she change the location for finger print to the office in the country where my mother is,
She is in Pakistan right now.

Pew confirms what we've already assumed is happening. The number of illegally present immigrants has dropped 8% since 2007. The number is now about 11 million, down from peaking at 12 million. The annual migration of illegally present immigrants has dropped from about 850,000 a year a few years ago to just 300,000 a year today. Why? You must submit the 485 through a lawyer if your priority is current, check the visa bulletin. You can always file when 140 is approved and you are still employed with same employer. You can also file EAD & AP for work permit and international travel. Get a lawyer asap.
