USCIS takes two steps(2 years) forward than takes three steps(3 years) backwards. When it takes forward steps, it confuses everybody by it's stupidness of approving later PD cases and than moves backwards after realizing it's blunder. In this whole process, we spend time analyzing, debating, chatting on what USCIS will do next but they throw all our logic out the window and go their own way. This whole process sucks!!!!
You see in the real world everything moved 1 year ahead from October 2007 to October 2008. So in USCIS world also it moved by 1year.

This is really sad. I dont expect Eb2s to understand EB3's plight, but to blame the EB2 backlogs on EB3, and the false accusation that we are getting EADs out of turn -- that is simply disgusting. While you are at it, why dont you blame EB3s for all the ills in the world, say the war in Iraq, Darfur issue, the gas prices, terrorism, the housing collapse in USA, Nazi genocide. Please feel free to explode the list at your will. You are obviously more wizened than EB3s, so we might be doing things without our knowledge.
I hope there is more and more EB3 interfiling, so that these "holier-than-thou" EB2s get their misplaced sense of superiority smashed to smithereens, and get to know the pain of waiting for long periods of time.
Most EB2 justify the need for getting their GCs sooner is because they have been here longer (throwing out numbers like 1995, and such). They dont even realize that the actual "wait counter" starts after filing for GC. If you could not hold on to a job or joined a job that did not sponsor your GC earlier. that is your fault. Not USCIS' not EB3s' yours. Get it. YOURS!.
If you are so special take some time to read the law. Labour substitution was not defined in the laws, which is why it got explicitly junked. PD porting is part of the law.
If you want to work on an action item work on 5882.

I live in Georgia and I agree with you all. All these DMVs were sleeping and woke up after 9/11 and imposing these strict rules that makes everyone's life miserable. Unless you live in a city life will be hell without DL and we are sweating it over every time a renewal comes up. How am I suppose to explain DMV guy about I-94, H1 extension etc. Even some immigration officers in airport give wrong I-94 expiry date without understanding the difference between visa stamp and extension.

The Mexico F2A and Employment Third preference cut-off dates are “unavailable” for both August and September, since those FY-2008 annual limits have been reached. The Visa Office had originally anticipated that this would be a temporary situation. Then with the start of the new fiscal year in October the cut-off dates would have returned to those which had applied during June. However, continued heavy demand in those categories may require the establishment of cut-off dates which are earlier than those which had applied in June. A formal decision determination of the October cut-off dates will not be possible until early September.
My take on this is that there might be some balancing act across the EB3-Sub categories. If you notice in the June 2008 dates, there is a huge discrepancy in the EB3- Sub categories.
For example, Philippines is 1-Mar-06 and India is 1-Nov-01.
Who knows, they might move back the EB3- Philippines/ROW and move forward (or leave it on 1-NOV-01) the EB3-India dates.. This is a possibility from the text of the September 2008 bulletin. So, it's not all gloom and doom for EB3 Categories..

You need to take control of your family. The problem is that you allowed your inlaws to take control of your family. Second problem is that at the time of delivery the girl probably wanted her parents to come to US but you probably called your parents and she didnt like this nor did her parents. But that does not mean her parents will emotionally blackmail her.
1) You should tell your inlaws politely and candidly that they are interfering in your family and that needs to stop. Also communicate with your inlaws through your wife. Do not communicate with them directly. You did not marry them. They are no body to you, legally.
2) Your wife is under immense stress due to baby and parental pressure to control her. Her parents are trying to control your family through her. This is not the time to talk about separation because she has a young baby and she needs you as much as you need your baby. So you have to tell your wife what your inlaws are doing is not acceptable and just be firm that you will not tolerate it if she wants to live with you. And let her choose between her parents and you. This will be hard but you have to show some mental toughness.
3) When you got married , you started new family, you moved out of family of your parents. Though you dont have to break up with them, there may be some things that your parents do, that your wife does not like. You might think it is OK for your parents to advise or ask her to do things in certain fashion, but, it is NOT OK if she doesn't like it. She is a matured adult and can take care of her new family. So if you wish good of your parents, you have to "keep them at a safe distance." They should not interfere in your affairs.
4) You both husband and wife, need to handle each others parents in a matured way without insulting them. Both of you cant change your biological parents, but you can handle them diplomatically without insulting.
If this doesnt work, and you really want to separate, just tell your wife, that to allow things to cool down, you can live some place else for 3 months and assure her that you will take care of her and the baby. That will send a very clear message to your inlaws of the things to come. You just cant threaten to separate and run away.
Last, I do not know again how you treat your wife and inlaws. I dont mean to judge but do you treat them right? Why are they so desperate in this situation? Also I do not know any money transactions you have with inlaws, but, I would say, its not a good idea to involve inlaws in any kind of money. You invite 50% problems there.
Also I am confused, are you living in India or US?

I don't think so. Eventhough they make U in september bulletin. They have to move dates in October bulletin because of new visa numbers.
I can understand the excitement. I am also in EB2 2005 PD. But the fact is that, this seems like a temporary movement only...i don't think dates can stay at 2006, going by simple math.
PPl can give me those red marks, but i think dates will retrogress again by Oct.

Voting seems to be on political lines. Democrats probably didn't want to yield any ground because of their dear CIR failure. We need a targeted campaign (strategy) on the Democrats - Hillary spoke very favourably to the Indian student community recently about H-1B and immigrant visas but her vote is not in line with her statements

They highly receommended that people should maintain H1 status as much as possible until the GC process is fully complete.
Regarding EAD they said
. it is a blanket work authorization but you should watch for expiry date and maintain its continuity to keep working.
. interestingly to Murthy's surprise, the EAD has been extended by USCIS even if a MTR is pending. This is unusual as there is no written word about it and preciously USCIS used to deny EAD extensions.
. AOS is authorized stay even if your EAD expries. You are not out of status with EAD expiry but you must renew it ASAP.

We're much better off here in the US when you compare our compatriots suffering in Britain. Britain has enforced a lot more regulations on immigrants, much to their chagrin.
Let's grin and bear it and hope to see the 'green' light at the end of the tunnel.
That's exactly the point..USCIS is HEADED by fools...the problem lies within...the heads dont really care if their staff is underpaid and over-worked..but the fact of it is that they just don't have the money nor manpower to get the work done. When USCIS adjudicated all those cases in 2002, it was not of their own volition but because Congress mandated it..6 years later they dont care for the immigrants..u think they'd (policy makers) care 2 hoots for the the USCIS officers...just take a look at the Infopass centers...from my experience I havent seen more than 2 officers helping customers at a time..no money..no manpower

That's exactly the point..USCIS is HEADED by fools...the problem lies within...the heads dont really care if their staff is underpaid and over-worked..but the fact of it is that they just don't have the money nor manpower to get the work done.
