Hello Guys,
I need urgent help please.
I am on 8th year of my H-1B, expiring on July-2008.
I am on EB3 Nebraska, PD 07/2003.
I-140 pending � RFE on Education (3 years degree) replied on December-2007
EAD approved on September-2007.
I485 aplied on july-2-2007
Just got an email from Cris that my I485 was denied. I don�t know the reason.
My I140 is still pending � almost 4 months after my attorney replied the I140 RFE.
Today I am writing this in order to understand my available options and strategy to this situation.
I have less than 2 months on H-1(b).
What are my options?
Anybody in the same situation?

My attorney want's to file my I-485 now to have a receipt that it is filed and sent back by USCIS. This shows up that I was capable of filing in July but I could not because USCIS did not accept on the last minute.
The Idea behind is that it will give advantage to my application if AILF wins the case.
Please let me know is this a good thing to do at this stage.

I have received notice for I-485 FP, but my I-140 is still in process (not approved or anything). How is this possible? Is it because of concurrent filing?

yes, its normal and ok. Your 485 will be processed independently of your I-140, and your fingerprinting, namecheck etc will all keep happening. You just cant get it approved without getting the I-140 approved first. Everything else goes on in parallel.

Dear all:
May I ask what I should do in the following situation?
I hold F1 visa and my new job starts on Sept 1. The int'l student office of my current university mistakenly set my OPT start date on May 6. My OPT has been approved and EAD card arrived.
That is, I will have 120-plus "unemployment" days accumulated by early August, which will then violate the "90-day unemployment rule" of OPT.
I am under tremendous pressure and really want to hear your opinions.

I am a July filer and have the option of working for a reputable company as expert consultant for 6 months (initial offer). Yates memo indicates that self-employment is possible. Here is my question: Do we need to register a company to be considered self-employed? As a consultant you may not have a customer for while. Isn't it better to register a company if you want to claim self employment? What are the pros and cons of registering a company?

I am currently on H1B visa which will expire next year ie Nov2011. My employer just stated that due to economic conditions, they will not be able to file my GC.
My husbands company has already started his GC process ( his labor n I140 is done)but my name isnt on his application yet. We are waiting for the date to become current n then my name can be added on is 485 application as his dependent. His PD is Aug 08.
Basically I was interested in knowing abt future based employment GC. Has anyone done that before?
Is anyone aware of companies who would be interested in doing it. I just need to buy like max 2-3 years ....just to keep my H1B extensions going. I like my current job so really want to avoid changing it unless there r no other options left basically.
Pls suggest me options that I have to get H1B extension after Nov 2011 and continue working.
Any suggestions are appreciated. Thanks!

I am trying set up an appointment for the last week of April (Apr 27-May 1) in Matamoros, Mexico and came across the following website about their wait times:

Yes- you can start sole proprietorship on EAD and there is no need to inform USCIS. Only complications will be taxes, nothing else.
Sole Proprietorship should not become your main employer if you are main (primary) applicant of 485 application.

Yes, the AP is valid for one year and for as many visits as you want. Same thing happened with me. You can travel again with the stamped AP.
