My I-485 is pending with PD of Oct 11 2006(EB2 India). I have been on H1 as was not able to add my spouse to my initial 485 application. As my H1 expires on Sep 6, we recently filed for H1/4 extension and received an RFE for Employee-Employer relationship. We have to answer this by Sep 13. As a Plan B, What we did in June 2010 was
a) I filed for my EAD
b) My spouse got admitted into a school here and applied for COS from H4 to F1 with a valid I-20.
Both of these cases are currently pending.. My questions are:
1) As our H1/4 and I-94 expires on Sep 6, Would we still be in legal status after Sep 6 as both of our cases (EAD and COS) are pending?
2) After answering the RFE, if it is denied, would it impact my GC processing?
3) I understand that even if my H1 is denied, As I have a pending EAD, my status would be okay but what options would we have if my Wife's case is denied.
Thanks in Advance!

usually after 'card production' , there will be an update with 'approved'
try taking an infopass and get more details on the case
AFAIK - approved EAD is required to work

Hi,
I want to ask whether this new Memo for validity of employer-employee relationship is being questioned in case of Port of Entry for existing Stamped H1b holders who are planning their short visit to go and come back in US.
Thank you in advance

Hi All,
My wife is currently working on H1B. She recently got her EAD through my GC application (I am the primary applicant). Can she use her EAD to work for her current company who is holding H1B?
Appreciate your response immediately
Thanks in Advance
yes, just fill out a new I-9, this time indicating that you are going to use your EAD.

yes, was and thought about it. Just woke up to see Life without GC is still the same and I am a day old. Now, I feel relaxed. Now, there is no need to check or wait for bulletin for the next one year or to atleast have any hope.

Immigration policies at today's USCIS may change in a flash. They can be announced and then, without forewarning or explanation, withdrawn in the milliseconds it takes for the agency's webmaster at www.uscis.gov to push the upload and delete buttons. At times they are as reliable and ephemeral as the inducements of a carnival barker. Take for example a January 19, 2010 policy memo, "Signatures on Applications and Petitions Filed with USCIS" (penned by USCIS Acting Deputy Director, Lauren Kielsmeier). The memo appeared evanescently and then, as Ron Ziegler, Richard Nixon's former press secretary in the Watergate era, might have said,...

My H1B Visa stamp expires in Jan 08 but H1B Status expires Sept 08. Is it too early to get a new H1B stamp 4 months before expiration of the H1B stamp I currently have.
I am planning to go to Ottawa now for a stamp that expires in Sept 08.
Thanks for your help.

1) Wrap up the backlog and introduce enough visas to make all categories EB2/EB3 current for everyone.
2) Eliminate this nonsense of H1 visa stamp. A person should be able to apply for visa while remaining in the US.

Hello,
I would like to prepare for the worst scenario that might happen in near future since I only got about two months of H1B
I didn't even know what " RFE" was until I recently received it. From my first H1B app to LC, things have gone so smoothly.. but now I am starting to realize that this could be jeopardize my whole career in U.S if I don't get approved from I140.
When I started my PERM processing last year,my lawyer made sound so easy about getting a GC that the paralegal who handles my case has never told me anything about" if things goes wrong",which I am afraid that it might be happen soon...
If I get denied from I140, Is there a way to extend my H1B ? or any other way to keep my job in U.S legally ? Could anyone give me some advice ?
my status:
Apr 2009 Priority Date EB2
May 2010 I140 EB2 filed
May 2010 I1485 filed
July 2010 I140 RFE
H1B 6th year (exp. OCT1 2010)

It seems that everytime you breathe in and breathe out, there is a new immigration story or event which may affect you. A new law is introduced in Congress, another Visa Bulletin is published, the USCIS has yet again updated its processing times, the Courts have decided an important immigration case, the H-1B cap has been reached, etc., etc. How do you keep up with all of this without driving yourself totally crazy? Yes, there is the Internet. But there are thousands of attorneys and multiple government agencies all posting immigration news at the same time. You could subscribe to...
