Hi There,
I need some advice on my current situation.I am in the 4th year of my H1-B .I have my
I-140 approved from my current employer with PD of Aug'09.
I am planning to change my job, my concern is :
Assuming that my current employer do not revoke/recall my I-140
1. Do i need to have the same job responsibilities in my new job to transfer my PD?
2. Do i have to stick with my current employer for atleast 6 months to transfer my PD?
3. What will happen if i change employer within 6 months, can i still be able to get my PD?
4. Will employers provide approval of I-140 ?

Hi,
My friend has approved H1B with his previous employer and visa was stamped in 2006 in India. Visa is valid till end of 2009. He never came to US and he does not work for the employer(like Wipro) anymore in India.
Now he wants to come to US with new employer. What are the choices? As I know to transfer H1B to new employer he should be in US and with other documents like paystubs, SSN, etc.
I appreciate your response.

I am a doctoral student in clinical psychology, graduating next year in May or October. I am currently on an F-1 student visa and have heard ominous things about getting an H1-b and GC in my field.
I know I have time and things can change, but it seems like they are becoming more difficult. Hence if there are people out there who have ideas, experiences and information to share about what the process is like for potential psychologists to get sponsored, I would greatly appreciate your reply.

For my 9th year H1-B visa extension, i want to use the premium processing. All the attorney fee and any other expenses will be paid by my company. I want to pay only the $1000 for premium processing. Is this legal ? Can the attorney attach my $1000 check signed by me, to the visa extension application with all other paperwork and send it to BCIS ?
If this is not legal what are my options ?
Please let me know.

Case against his employer had held in the past year and he was doing right to get his right to get the money back so he was not doing anything wrong in the past with his employer but how the new employer of his company react on that background and understand is totally depends upon them but don't worry about it, he was not wrong.

One of the stand out football players for the United States Military Academy at West Point is junior Alejandro Villanueva, a Spaniard who played high school football in Belgium. The wide receiver is also the tallest player in all of college football - 6 foot, 10 inches. Villanueva will have to serve five years in the Army after graduating and will probably be deployed to Afghanistan or Iraq. My cousin who came here on H4, found a company that sponsored her H1-b and she was working as a consultant to a big firm. She had to return to home country last year, and she had to get her papers stamped - which was denied.
she continues to work for the same firm from India. She has a house in the US, that she has put on market, and continues to pay the mortgage. Does she realistically have a chance of returning to the US on H1-B?

If you engage in employment, including self-emplyment outside of your H1 employment you violate the terms of your H1 status. If USCIS becomes aware of such employment, they will find that you gave up H1 status.
